PRE-ORDER AGREEMENT

1. All specifications/ prices are subject to change without notice
2. Prices & statutory levels prevailing at the time of delivery applicable
3. Delivery of the vehicle on availability of stock and colour
4. Delivery is subject to full payment and all required documents
5. We will try our best to match the colour preferences but it can not be guaranteed as slight variation can be there between online screen and offline prints. It is subject to availability.
6. Booking cancellation amount 750 INR (unless expressly agreed at the time of booking/ pre-order)
7. If the delivery is not taken within 6 months of booking, the entire booking amount will be forfeited
8. For the cancellation customer has to produce all original documents including Booking Forms and the Payment Receipts
9. Any refund of booking amount will be done by Cheque or Bank Transfer
10. All disputes are subject to Kolhapur Jurisdiction

These Pre-Order Terms and Conditions (“Terms”) sets out the terms and conditions applicable to Your pre-Order of the products and vehicles of Argon (“Pre-Order”). These Terms form a binding Agreement between You and Argon Mobility, an SBU of SwiftCurrent Technologies Private Limited, registered under the Companies Act 1956 and having it registered office at 1690, E-Ward, Vasant Pride, Suite 204, 8th Lane, Rajarampuri, Kolhapur 416008 MH IN and trade name owner of Argon Mobillity (“Argon”). For the purpose of these Terms, wherever the context so requires “You/Your” shall mean any natural person who has agreed to place the Pre-Order with Argon. The term “We/Us/Our” shall mean Argon.

Pre-Order

By placing a Pre-Order with Us, You express Your intention to purchase the vehicle specified by You at the time of placing the Pre-Order (“Vehicle”) and agree to be bound by these Terms. Your Pre-Order shall be subject to these Terms and delivery of the Vehicle by Us shall be subject to Your compliance with the obligations contained hereunder. You acknowledge and agree that Your Pre-Order is for delivery of Vehicle only to You and You may not transfer or assign rights granted to You under these Terms to any third party.

Pre-Order Amount

While placing the Pre-Order, You will be required to pay a Pre-Order amount as specified by Us (“Pre-Order Amount”). The Pre-Order Amount will be adjusted in Your final invoice at the time of purchase of the Vehicle and You shall be under the obligation to pay the remainder of the Vehicle price.

Delivery Schedule

Upon payment of the Pre-Order Amount, We will provide You with an estimate of the time required by Us to deliver Your Vehicle. We will specify a time-period during the calendar year within which We will attempt delivery of the Vehicle. We would exercise all commercially reasonable efforts to deliver Your vehicle within the promised time-period. You acknowledge and agree that there may be delays and We may not be able to deliver the Vehicle within the specified time-period. In which case, We agree to notify You and specify the revised estimate of time within which We would attempt delivery of the Vehicle. You acknowledge and agree that We shall not be liable for any damages, losses, costs or expenses incurred by You due to delay in delivery of the Vehicle by Us. However, in the event of any delays, You may cancel and claim a refund of Your Pre-Order Amount in accordance with these Terms.

Cancellation of Pre-Order

You may cancel Your Pre-Order at Your discretion. Upon cancellation of Pre-Order, You shall be entitled to a complete refund of Your Pre-Order Amount, provided that such cancellation is made prior to in time or milestone specified to You by Us at the time of placing the Pre-Order. In the event, You cancel Your Pre-Order after such time as may be specified by Us, We may, at Our discretion, refund You the Pre-Order amount after deducting all costs incurred by Us. Further, We reserve the right to cancel Your Pre-Order, at any point of time and upon Our sole discretion. In the event We cancel Your Pre-Order, We will refund the complete Pre-Order Amount within a reasonable period of time or unless expressly agreed at the time of booking/ pre-order. All such refunds shall be made by Us within a period of 7-working days from the date of cancellation of Your Pre-Order.

Delivery Conditions

As a condition for delivery of Vehicle by Us, You shall provide Us with such information and documents as may be required by us to process Your Pre-Order. You represent and warrant that all such information and documents are accurate and updated. In the event of any change in the information or documents, You shall promptly notify Us for Us to be able to correct the relevant information in Our records and process Your Pre-Order. You acknowledge that the delivery of Your vehicle shall be subject to completion of statutory requirements and You hereby agree to take all steps specified by Us to fulfill such statutory requirements. You agree to extend all reasonable support as may be required by Us for delivery of Your vehicle, including without limitation such support as may be required for the installation of charging points or charging sockets. All the information shared by You shall be used by Us in accordance with Our Privacy Policy available at argon.mobi/terms. You acknowledge and agree that the delivery of the vehicle shall be subject to the conditions stated above and We will not be responsible for any delays caused due to Your failure to fulfill the conditions specified hereunder.

Territory

The vehicle is made available only in such areas or territories as may be specified by Us.

Purchase Terms

These Terms are applicable only for the Pre-Order of the vehicle. You acknowledge that the purchase of vehicle shall be subject to additional terms and conditions as may be applicable to purchase of vehicle.
Limitation of Liability, We shall not be liable for any indirect, special, incidental or consequential damages arising out of or in connection with these Terms. Your sole and exclusive remedy and Our aggregate liability under these Terms shall be limited to refund of the Pre-Order Amount.

Disclaimer

The vehicle delivered to You shall in all material aspects be similar to the vehicle presented or advertised to You during any marketing or promotional campaigns. However, You acknowledge and agree that there may be certain deviations or modifications in the actual vehicle delivered to You. Except to the extent of limited warranty provided under the terms of purchase of the vehicle and permitted under law, We disclaim all other warranties related to the vehicle, whether expressed or implied, including the warranties of fitness for a particular purpose or merchantability.

Miscellaneous

We will not be held responsible for any delay or failure to comply with Our obligations under these Terms if such delay or failure is due to any reason beyond Our reasonable control. In the event any provision of these Terms is held invalid or unenforceable, the legality and enforceability of the remaining provisions shall not be affected or impaired thereby. These Terms shall be subject to the laws of India and any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of courts of Kolhapur.
